Kilometer Charge

Must I have an OBU only on paying toll roads?
No. Your OBU must be switched-on on the entire road network in Belgium. The use of the road network, recorded by OBU, is only charged (by means of an invoice or payment document) when the roads used are subject to a rate greater than zero. The authorities will check the correct use of the OBU outside the major traffic axes as well.

Who does the kilometer charge apply to?
The kilometer charge applies to all trucks of more than 3.5 tons GVW and for N1 vehicles with body code BC.

How are the driven kilometres recorded?
The OBU employs GNSS (Global Navigation Satellite System) technology to record the distance traveled by the vehicle on which roads, and then calculates the appropriate fee.

How is the toll calculated?
The tariffs of the toll roads are fixed by the governments of the regions.
The tariffs have been fixed on the basis of three parameters:
- The Gross Vehicle Weight: the kilometer charge is due for trucks of more than 3.5 GVW. When the pulling vehicle has a GVW of more than 3.5 tons, the Gross Combination Weight Rating (GCWR) needs to be declared (trailer included when the truck is equipped with a tow-bar)
- The Euro emission norm: this is the emission norm that categorizes the level of pollution of the truck.
- The type of toll road: all roads in Belgium are toll roads. Most of them are charged at 0-tariff. Others have a paying tariff.

What do I need to do to be compliant?
Every heavy goods vehicle on Belgian roads must have a working On Board Unit (OBU). OBUs are available via one of the 6 accredited service providers: Axxès, Satellic, Telepass, Toll4Europe, TotalEnergies Marketing Services & W.A.G. Payment Solutions.

Are there adapted rates for zero-emission vehicles?
In Flanders and the Brussels Capital Region, a temporary preferential rate of zero euro cent/km applies to zero-emission vehicles – ZEV (Zero Emission Vehicles) – vehicles without an internal combustion engine or vehicles with an internal combustion engine emitting less than 1 g CO2/kWh. However, the OBU remains mandatory for ZEV. In Wallonia (Sofico), ZEV are still classified in the category Euro VI emissions. The measures applied were introduced with a view to encouraging the greening of the truck fleet driving on our roads.
In details:
- Emission-free vehicles with a maximum permissible total weight (MTM) less than or equal to 4.25 tons will not have to pay any kilometer charge during the period from January 1, 2024, to December 31, 2029 (for Flanders) and July 1, 2024, to December 31, 2029 (for the Brussels Capital Region).
- For emission-free vehicles with a MTM greater than 4.25 tons, the external cost charge (only) will be set at zero for the period from January 1, 2024, to December 31, 2029 (for Flanders) and July 1, 2024, to December 31, 2029 (for the Brussels Capital Region).
The remaining portion of the mileage charge is temporarily reduced
- by 100 % for the period from January 1, 2024, to December 31, 2025 (for Flanders) and July 1, 2024, to December 31, 2025 (for the Brussels Capital Region).
- by 80 % for the year 2026
- by 60 % for the year 2027
- by 40% for the year 2028
- by 20 % for the year 2029

Can I pay the toll after having driven through Belgium?
No, you cannot pay the kilometer charge after having driven.
Service providers

Who are the service providers and what can they do for me?
There are currently six service providers: Axxès, Satellic, Telepass, Toll4Europe, TotalEnergies Marketing Services et W.A.G. Payment Solutions. At your request, they will deliver an OBU to you. They will send you a bill or a payment document for the tolled kilometers you have driven on a regular basis. You have to pay the amount due to your service provider. They, in their turn, will transfer the whole amount to the region where the kilometers have been driven. In case of trouble with your OBU, your invoices or or a payment document, contact your service provider.

How are the data being processed?
The data are being transferred through GNNS-technology to a processing center which sends invoices and handles the payments.

On Board Unit

What is an On Board Unit?
An On Board Unit is a device that registers the kilometers driven on a payable toll road. The device is applied to the windshield and is in contact with the navigation satellite. It measures the exact number of driven kilometers; you will not be billed for more.

Where can I get an OBU (On Board Unit)?
To obtain an OBU, you can
- submit a request via one of the service providers
- or collect one from one of the 120 distribution points throughout Belgium. A map with precise locations can be found on www.satellic.be/service-points

How do I install my On Board Unit (OBU)?
The unit has suction cups and is attached to the windshield of the truck cabin. It is then plugged into the vehicle. Once the OBU data has loaded its data and is functioning correctly, the light is green, and the driver can use the Belgian roads. If you have any problems installing your OBU, please contact your service provider.

What do I need to do when the light on my OBU is red?
When you see a red light on your OBU instead of a green one, you may not continue to drive with your truck on the Belgian public roads. You must stop, contact your service provider by phone and follow the instructions given. This is the only way to avoid the risk of getting a fine.

How can I return an OBU?
When you don’t need an OBU anymore, or you are leaving Belgium for a longer period, you can return it to your service provider. Contact your service provider to learn how. When you got your OBU through a distribution machine when entering Belgium, you can also return it through the machine. The procedure can be found here.

What happens when I don’t have an OBU?
Offenders will be fined and need to comply with the regulation.

Can I use my On Board Unit in other countries?
It all depends on your chosen service provider. OBU's from Satellic only record kilometers driven in Belgium. OBU's from other providers can enable you to pay the toll in other countries as well. You can check the accredited service provider's websites for more information in function of your needs.

Out of scope/exemptions

Are there any vehicles over 3.5 tonnes that fall out of the scope of application?
Certain categories of vehicles fall outside the scope of the kilometer charge: some machine-vehicles to the extent that they do not transport goods (such as cranes, telehandlers / lifts, excavators, bulldozers, concrete pumps without mixer and dumpers), vehicles with a “Y” test drive license plate, old timer vehicles and training vehicles. Does the kilometer charge also apply to horse transport?
The kilometer charge is applicable to HWVs of more than 3.5 tons (and N1/BC vehicles), irrespective of the nature of goods they transport.
In this respect also trucks (category N) for horse transport – whether for private or for competition- fall under the kilometer charge. Therefore, they must drive on the Belgian roads with a switched-on OBU. Category M vehicles are not subject to the kilometer charge.
A vehicle without an OBU can be fined up to €2,400 per day (= €800 per region per day) if it crosses the 3 regions.

Does the kilometer charge also apply to old timers HGV?
As from 1 July 2023, the Kilometer Charge in Belgium does not apply to old timer trucks of more than 30 years old. (RD of 15/3/68 concerning the technical equipment of vehicles)
Vehicles registered in Belgium must have an O-license plate in order to drive without an OBU.
Foreign-registered vehicles complying with the terms of the Royal Decree are automatically considered out-of-scope and can circulate without an OBU. However, should you wish to have your vehicle registered (foreign vehicles only, not mandatory), you may do so by addressing an email to contact@viapass.be, be sure to add your onboard documents and a few pictures of the vehicle.
Beware: these old timers cannot transport any goods. If they do and drive without an OBU, fines can get as high as €2,400 per day.
It should also be noted that falsifying the vehicle's on-board documents to bring it into the “old timer” category can lead to a fine of up to €3,000 per day (=€1,000 per day per region).

Does the kilometer charge also apply to motorhomes/campervans?
If your motorhome is registered in category M (see your vehicle documents), you don't have to pay the kilometer charge. Most motorhomes are classed as M because they are designed to transport people.
In some cases, motorhomes are category N because they were used as heavy goods vehicles in a previous life. N vehicles are subject to kilometer charge.

Which vehicle categories are exempt from the kilometer charge?
The law explicitly specifies a number of categories that are exempt from kilometer charges. These are vehicles that are used exclusively by the military, firefighters, police and medical services (and recognizable as such). Tractors for agriculture, forestry and fish farming which drive seldomly on the public road are exempted. In the case of combined vehicles, the toll only applies if the maximum authorized mass of the tractor intended for freight together with the towing vehicle, is over 3.5 tonnes. Exempt vehicles must apply for and obtain an exemption.
The owners of a vehicle of over 3.5 tons that falls into one of the exemption categories, must submit an application for exemption to the region where their vehicle is registered.

Control

How is the kilometer charge controlled?
Drivers who don't have an OBU, who have an OBU but don't switch it on, who don't pay or who commit fraud on toll roads are identified using detection equipment 24 hours a day, 7 days a week. Fixed, flexible and mobile checks are carried out on all Belgian roads.

Who carries out the controls?
Controls are carried out by the regions.

How much are the fines?
The Regional tax authorities impose fines on truckers who do not meet the requirements of the Kilometre Charging System.
Since January 2018, the amount of the imposed fine varies according to the seriousness of the infringement:1,000 euros for a Category A infringement:
- manipulating the On Board Unit (OBU) with the intent to defraud
- falsifying the vehicle papers which are required to determine the maximum permissible total weight and the vehicle's EURO Emission Class (with the intent to defraud)
800 euros for a Category B infringement:
- there is no OBU on board the vehicle to calculate the toll in Belgium
- for the vehicle concerned, no service contract has been concluded with one of the providers accredited by Viapass to calculate the kilometer charge in Belgium
500 euros for a category C infringement:
- the OBU is not switched on
- the OBU present on board the vehicle is coupled to another vehicle (another license plate number)
- use of the Belgian road network after the service contract with the provider has been terminated
- use of the Belgian road network with an OBU after the means of payment linked to this OBU has become insufficient
- the OBU reports a problem or does not seem to be working, and the vehicle owner does not immediately contact the service provider
- the OBU reports a problem or does not seem to be working, and the vehicle owner immediately contacts the service provider, but does not comply with the instructions received
100 euros for a category D infringement:
- any other infringement to the kilometer charge not mentioned above
The first administrative fine of category C committed within the civil year is automatically reduced to €250.
The competent member of staff may reduce administrative fines for the same type of offense committed within a limited period, if the individual liable acted in good faith.

What is Viapass?
On January 21, 2011, the three Regions of Belgium, Flanders, Brussels and Wallonia, concluded a Political Agreement on the reform of traffic taxation. Instead of owning a vehicle, they wanted to tax its use. Therefore, a plan was outlined for a kilometer charge for trucks. This agreement would result in a cooperation agreement in 2014 and a decree framework in 2015 for the effective introduction of the kilometer charge for heavy good vehicles as we know it since April 1, 2016.
In order to achieve the control of the service providers, provide coordination between the regions and keep communication regarding the kilometer charge centralized and uniform, the Interregional Entity Viapass was created (Belgian Official Gazette July 17, 2014). Viapass coordinates, controls and communicates.
Service providers are responsible for everything related to the distribution of On Board Units, their operation and the invoicing of tolled kilometers driven.
In turn, enforcement of kilometer charge compliance is done by the regional tax authorities. Through fixed, flexible and mobile control units, they can check for proper compliance with the kilometer charge and, in case of violations, fine them. Road users should therefore contact their service provider for everything concerning the On Board Unit: whether for information or purchase, in case of defects or for invoicing and payments.
